Our judiciary was designed by the bunch of foreigners  during the colonial era and it was designed in such a way so that people can be legally be deprived of justice. Indian penal code is not for distribution of justice but for getting injustice , it's so slow that the foreigners planned it to be . The British wanted that the system of judiciary should be slow so that the casses remain pending for 10 - 20 yrs . Justice delayed is justice denied.

Kese chala de shifts me? Itne laws hai, itna kuch hai, properly educated  and experienced judges ki bharmaar hona chahie. No doubt there is a need for an overhaul, but don't think it is just the judges and advocates who are at fault. Who promotes legal education? There is a new revolution with CLAT and NLUs now, like 15-20 years ago this started and it takes around 30 years to make a good lawyer. The parliament is empowered to make courts work two shifts with more and more judges, but then a whole ass system needs to be built. Stop just blindly and blatantly criticizing the "system". It is easy to criticize but so damn hard to make it work and it is these politicians and other goons who have ensured that their supremacy remains and the rest should come to lick their asses for anything.

This guy is confusing executive with judiciary, which we tend to do a lot in India. Fixing potholes isn't the court's job, it's the executive's job. We just look to the court because our politicians are useless, corrupt or both. 

The pending court cases are because of a shared issue between judges and gov't - lack of judges. On the side of the gov't, it has increased the sanctioned strength of judges far too slowly - we are presently at about 25,000 judges for a population of 1.4 billion, far too few. We need to double that number at least to tackle backlog, and gov't also needs to clear judicial apppointments faster instead of sitting on hundreds of them for years at a time.

But judges are also complicit. They guard their independence jealously, and so when gov't tries to reform the collegium and the process of selecting judges to increase the speed of decision-making, they react furiously. They are also part of the problem.

While I agree courts need to function more, but courts are a function of Law. Its governments' job to execute better. Courts are only for dispute resolution as a third party upholding law. If your govt is busy playing dumb shit for themselves, courts cant do jack shit. Its Govt's job to look at law and improve it make it adhere to today's and tomorrow's need.

The fact is government is only interested in departments, which get them revenue, both over and under the table. Government is more interested in traffic, making tenders for cameras, air purifiers, air conditioners, building roads etc
Judiciary gives a very limited revenue. Moreover if the political system strictens the laws, channelises the judiciary, then they all will come under scanner. I hope everyone of us can understand this.

Judiciary is meant to interpret law and give punishment/relief according to it. Application and enactment of law is is the domain of Executive and Legislature respectively. That is basic civics.

If you want the judiciary to do things about potholes and street vendors, the parliament should bring amendment dissolving parliament, all state legislatures, all municipalities, all cabinets and delegate absolute power onto the judiciary. But it won't.

Increase in the number of judges could be a solution but they need to be more efficient then the ones that exist and latter aspect was addressed by CJI as he  mentioned that current District court judges fwd the cases to High court and further up to SC as they do not want to take a decision and held liable to be politically incorrect or be a part of any such controversy.

Judges of India play various roles like Gender identifier Specialist,Environmentalist,Public Motivator,Marriage Specialist but in that process they forget that they are appointed for bringing changes in the society which affects majority of Population not some bunch of idiots who thinks world revolves around them.

Indian judiciary in its current form is a colonial extension. It needs to be decolonized first and fully rebuilt inside out. 

Just like we have special hospitals for various illnesses (cancer, general health, orthopedics, geriatrics, pediatrics, gynecology and so on), we need separate courts for different issues. Today we have one court system dealing with everything. Courts must be set up exclusively for cases of :

1. Fraud, corruption, tax evasion, bribery etc.
2. Anti-national activities/terrorism, Police, Military personnel
3. Rape, murders, accidents
4. Land and legal disputes
5. Divorce, dowry related issues
6.  Religious disputes
7. Constitutional issues
8. Business related issues (patent violation, industrial spying etc.)
9. International issues (visa violation, illegal migration, arrest of foreigners etc.) 
10. Pollution related, enviornmental issues
11. Traffic related (violations, illegal blocks etc.)
12. Political cases
13. and so on.

In some cases, there will be overlap. But each aspect must be addressed in the respective court.

We really do not need a supreme court. Just like Indian administrative service or UPSC exams, people with law degrees must be able to write a nationwide exam that qualifies them for an Indian Judicial Service. Only those who get through this should be eligible for becoming Judges. Others can remain as lawyers. 

Each region must have its own legal headquarters (where complex cases are heard through appeal). Jury based hearing must be brought in for certain cases like rape, domestic violence etc.

People should be able to file cases through on line forms (with proper identification set up). AI should be engaged in giving certain verdicts that can be automatic (like someone challenges the fine he got for some violation and AI should be able to give the verdict based on all the legal aspects and give the proper explanation to the complainant). 

Courts should work two shifts, seven days a week, with judges and lawyers working through assigned shift timings. After all our esteemed CJIs agreed to hear Teesta's case over midnight. So they can work if the demand arises.

Judges must be politically neutral and any judge bringing in political bias must be challenged and fired or demoted. 

Corrupt judges must face life imprisonment and they must be prosecuted under the same court that deals with military, police (#2 above).

We need police and judicial reforms badly.

The Indian Judiciary is super corrupt, super inefficient, lazy and basically thinks that they can dictate what the government &amp; people should do. The fear of what will happen if you have a case go to court in matters pertaining to real estate is so severe that people rather let go even when they have a strong case rather than fight it out in court. The issue you are raising is feasible for a smaller country, there are so many cases in our country it is not practically feasible for the prosecutor to do the investigation and gather evidences.

The problem with the legal system isn't this, it is simply that the buck stops with the SC and their verdict is the final nail in the coffin.

There is Noone above them, who would force the country  to abide by the law like the ICC, where people can fight back and non partial verdicts are given.

Your key issue is going to be the severe shortage of adequate prosecutorial services in India. The reality is that the way we've structured the judiciary, especially in terms of a lack of restraint from higher courts and the endless array of appeals that shuttle a case up and down the system (rather than having trials quickly and then appealing legal issues together), means that the system is perpetually overwhelmed. Adding to the workload of prosecutors isn't going to do much to help. If anything it'll slow things down even more, increasing unwarranted detention as even the investigation moves at pace of case resolution, which is to say shit will take decades.

Put it another way: If the issue is a lack of legal training, and the cops are woefully undertrained, why not simply mandate that all investigative police must be law graduates? Or obligate LLB levels of training for all police recruits, especially IPS level officers. In both cases, the issue is going to be the system's inability to provide adequate resources. We don't provide enough education, and we insist on recruiting massive numbers entirely through idiotic exam systems that actively prohibit expertise because we insist the exams must test a generality of knowledge so that *everyone* can become a government servant.

The problem to how we handle criminal jurisprudence is going to require a wholesale renovation of the judiciary, and at minimum severe curbs on the appellate jurisdiction of the Supreme Court, strong curbs on how the HCs handle cases, and a massive expansion of the subordinate judiciary to properly tackle cases.

You start having judges actually resolving cases, in reasonable time frames, and it'll be much easier to sort out where the police are fucking up things and resolve them in targeted ways. You might also need to actually start holding the state to *account* for its extreme incompetence given its colonial attitude of jailing first and investigating later in too many cases.
